RE: The tariff classification of a woven label, from an unspecified European country.

Dear Ms. Dawson:

In your letter dated June 17, 2008, you requested a tariff classification ruling.

The instant sample, consists of a woven label measuring about 3" x 1¾" (rectangular) that is composed of a 65% polyester man-made fiber/35% cotton blend. One side appears to contain a light silvery coating which is akin to a foil print and is considered to be a plastics material. The label has been printed on the foil print side with a stylized logo bearing the brand name: “teutonia”. After its importation into the United States, this label is to be sewn onto a car seat canopy.

The applicable subheading for the label will be 5807.10.0520, Harmonized Tariff Schedule of the United States (HTSUS), which provides for labels, badges, and similar articles of textile materials, in the piece, in strips or cut to shape or size, not embroidered: woven, of man-made fibers. The duty rate will be 7.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
